TERMS & CONDITIONS
The event will be held, rain or shine, unless the area is declared unsafe by officials for any reason. In this case, the event will be rescheduled to a later date. All monies received and confirmed registrations will transfer to the new date.
No refunds on cancellations or no-shows. Once payment is received, it will not be refunded.
Mountain Mud and its committee members/businesses will not be held responsible for any liability, lost, stolen, or damaged merchandise or any injury incurred during the event.
ACKNOWLEDGMENT & ACCEPTANCE OF RISK
I understand that the participation in Mountain Mud and all its activities and events involves danger of encountering both know and unknown hazards and risks which could result in injury, death, illness or disease, physical or mental injury to myself, my property or to spectators or other third-parties and knowing this I do hereby assume any and all risks and dangers and all responsibility for any losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the event coordinators event staff, vendors, sellers, sponsors, insurers, and their owners, agents, officers, employees, partners, parents, subsidiaries, trustees or affiliated companies or divisions, predecessors, successors in interests, and assigns.
INDEMNIFICATION AGREEMENT
For and in consideration of being permitted by the Town of Bradshaw and Mountain Mud, partners, associates, affiliates or sponsors (hereinafter Mountain Mud or event) to use its facilities and to participate in the event and activities, on behalf of myself and/or minor, I agree to this WAIVER, RELEASE AND INDEMNIFICATION AGREEMENT: the undersigned agrees to this WAIVER AND RELEASE and stipulates and agrees to SAVE AND HOLD HARMLESS, INDEMNIFY, AND FOREVER DEFEND the MOUNTAIN MUD, IT’S LICENSORS AND LESSORS from and against any and all claims, actions, demands, expenses (including reasonable attorney’s fees), suits, damages, liabilities, or causes of action of whatsoever kind or nature, whether sounding in negligence or otherwise made or brought by the undersigned person and/or minor, or by anyone on behalf of the undersigned as a result of the undersigned’s participation in the Mountain Mud event and activities and my use event area.
WAIVER & RELEASE OF LIABILITY
I acknowledge and agree that I and/or the minor participant are aware of the dangers and, even so I do hereby on behalf of myself and/or the minor, our personal representatives and/or our heirs, executors, administrators and assigns, voluntarily agree to RELEASE, WAIVE, DISCHARGE, HOLD HARMLESS, DEFEND AND INDEMNIFY Mountain Mud, partners, associates, affiliates or sponsors from and against any and all Claims made or brought by the undersigned person or minor, or by anyone on behalf of the undersigned person and/or minor, for bodily injury, damage to property, wrongful death, loss of services or other Claims which may arise out of my use or participation in the events and/or the minor’s use and participation in the events and any activities related to the event. I specifically understand that on behalf of myself and/or the minor I am releasing, discharging and waiving any Claims that I and/or the minor may have presently or may have in the future for any negligent acts or other conduct of Mountain Mud, partners, associates, affiliates or sponsors . This document shall be binding on the heirs, executors, administrators, and assigns of myself.
RELEASE
In consideration of being permitted to participate in events and activities of Mountain Mud, on behalf of myself and/or the minor children I am the parent, legal guardian or otherwise responsible, any heirs personal representatives, or assigns do hereby release Mountain Mud, its principals, directors, officers, agents, employees, volunteers, partners, associates, affiliates or sponsors from any and all liability and waive any claim for damages arising from any cause whatsoever (except that which is grossly negligence). I further agree to reimburse you for all attorney fees and costs should I bring legal action against you and lose. I am over the age of 18 years old.
By registering for Mountain Mud or any events or activities associated with or suggested by Mountain Mud staff or volunteers, you agree to our terms, conditions and waiver of liability terms.
RECORDED MEDIA
Your entry and/or presence on the event premises constitutes your consent to be photographed, filmed, and/or otherwise recorded and to the release, publication, exhibition, or reproduction of any and all recorded media of your appearance, voice, and name for any purpose whatsoever in perpetuity in connection with Mountain Mud (including its committee members and their businesses, staff and volunteers), its initiatives, including, by way of example only, use on websites, in social media, news and advertising.
By entering the event areas, you waive and release any claims you may have related to the use of recorded media of you at the event, including, without limitation, any right to inspect or approve the photo, video or audio recording of you, any claims for invasion of privacy, violation of the right of publicity, defamation, and copyright infringement or for any fees for use of such record media.
